These Terms are an agreement between you and GEEKDEV TECHNOLOGIES, SRL (“we”, “us”) about the Gymfolio iPhone app. By using the app you accept them. Our Privacy Policy explains what happens to your information.
1. Licence to use the app
We give you a personal, non-transferable, revocable licence to use Gymfolio on Apple devices you own or control, under these Terms and Apple's App Store rules. You may not copy, resell, or reverse-engineer the app, or use it to build a competing service.
2. What the app does, and what it does not
- Gymfolio reads a workout you write as text and turns it into steps, rests and a timer. Reading is automatic and can be wrong: a number may be read as the wrong weight, reps or time. The app marks parts it is unsure of, but please check the workout before you start, and always lift what is safe for you, whatever the screen says.
- Some lines are read with the help of an AI service (see the Privacy Policy). Its answers are suggestions, not instructions.
- Exercise pictures, descriptions and calorie estimates are general information. Calories are rough estimates, not measurements.
3. Your health comes first
Gymfolio is a training tool, not medical advice, and it does not diagnose or treat anything. Talk to a doctor before you start or change an exercise program, especially if you are pregnant, injured, or have a health condition. Stop exercising if you feel pain, dizziness or shortness of breath. You exercise at your own risk.
4. Subscription, free trial and payment
- Gymfolio is sold as an auto-renewing subscription. The plans, their prices in your country and any free trial are shown in the app before you buy; prices are set through Apple and include any taxes Apple collects.
- If a plan comes with a free trial (for example 7 days), you are charged at the end of the trial unless you cancel at least 24 hours before it ends.
- Payment is charged to your Apple Account when you confirm the purchase, or when the free trial ends.
- The subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the period ends.
- Manage or cancel it anytime in iPhone Settings → your name → Subscriptions. Deleting the app does not cancel it.
- Purchases are handled by Apple and follow Apple's terms and refund policy. Refund requests go to reportaproblem.apple.com.
- If we change a price, Apple tells you before it applies, and you can cancel before you pay the new price.
5. Fair use
The reading service has daily limits per phone that ordinary training never reaches. They exist to keep the service fast and affordable for everyone. If a phone sends far more than a person could, or tries to use the service outside the app, we may slow or block it.
6. Your notes
Your notes and workouts are yours. You give us permission to process the lines the app sends to its reading service, only to read them for you and, if you turn on the reading-feedback setting, to improve how the app reads. You are responsible for what you write in your notes.
7. Age
You must be at least 13 years old, or the age of digital consent where you live if that is higher, to use Gymfolio.
8. Acceptable use
Don't use the app or its service to break the law, to send content that is not a workout to the reading service on purpose, to overload or attack the service, or to get around its limits or the subscription.
9. Intellectual property
The app, its design, its text and its code belong to us or our licensors. Exercise data and pictures come from RepDB and are used under its licence. Nothing in these Terms gives you a right to our names or logos.
10. Disclaimer of warranties
The app is provided “as is” and “as available”. To the extent the law allows, we make no promise that it will be error-free or always available, or that its reading, estimates or information will be accurate.
11. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses, or for injury that results from how you exercise. Our total liability for any claim about the app is limited to what you paid for it in the 12 months before the claim. Nothing here limits liability that cannot be limited by law.
12. Ending it
You can stop using the app at any time; to stop paying, cancel the subscription as described in section 4. We may suspend access for someone who breaks these Terms. Sections 3, 9, 10 and 11 continue after these Terms end.
13. Apple
These Terms are between you and us, not Apple, and Apple is not responsible for the app or its content. Where you download the app from the App Store, your use is also subject to Apple's Licensed Application End User License Agreement. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Any maintenance, support and warranty obligations are ours alone, not Apple's.
14. Changes
We may update these Terms. We will change the date above, and if a change is significant we will tell you in the app before it applies. If you keep using the app after that, the new Terms apply.
15. Governing law
These Terms are governed by the laws of the country in which GEEKDEV TECHNOLOGIES, SRL is established, without regard to conflict-of-law rules. Nothing here affects mandatory consumer rights you have where you live.
